Agreement Introduction

 

AUSTARS MODEL PTY LTD is a TRADE-ONLY company. The words 'we, our, us, AM' refer to AUSTARS MODEL PTY LTD, located at 89 Jedda Rd, Prestons, NSW 2170. The words 'you, your, yours' refer to local retailers, resellers, associates suppliers, modelers, or registered users. When ordering from our website, you agree to acknowledge and be bound by the conditions or terms outlined in this agreement in-between. We keep the rights to amend this agreement at any time in our discretion by posting all amended terms on our website. This agreement is effective on 5th August 2007.

General Errors
AUSTARS Model Pty Ltd. makes every effort to ensure the accuracy of the information published on our Website and all documents. However, the documents and graphics published on our site may contain technical inaccuracies or typographical errors. Any inaccuracies on our website or our documents brought to you will be corrected by us ASAP.  AUSTARS Model makes no representations about the suitability of the information and graphics presented on this site. All such documents and graphics are provided "as is" or 'as available' without warranty of any kind. We do not accept any liability for mistakes, errors, absent information or effect. We are not responsible for any damages or injuries a person inflict on themselves or others as the person is directly or indirectly relies on any information on our website.

Pricing Errors
If an error occurs and a product is listed at an incorrect price, AUSTARS MODEL PTY LTD. shall maintain the right to refuse or cancel any orders placed at the incorrect price. If the order has been confirmed and charged to your credit card or your account, AUSTARS MODEL PTY LTD. shall immediately issue a credit in the amount of the incorrect price. We do not guarantee AUSTARS MODEL PTY LTD prices listed on other websites. Once customer accepted our PI and agreed with the product price, freight/postage costs, discount, or free gifts (conditions apply), the order is confirmed and would be processed.

Liability
Austars-Model.com does not accept the liability for “ Lost Air Mail” parcels sent without registration. We do not accept responsibility for injury and/or crash damage or loss of kits, engines and accessories, parts and materials that occurs during the use of any radio-controlled model. The user shall determine the suitability of the product for his or her intended use and shall assume all risk and liability in connection therewith. If the user substitute or replace normal kit hardware and/or radio components with after-market accessories, we cannot be held responsible for problems or equipment failure caused by incompatibility or modifications. This includes all other products sold by AUSTARS MODEL PTY LTD.

Goods Delivery

§  Domestic Orders in Australia will be delivered by road or airfreight depending on your options. Freight cost of delivery will be known and shown at time of purchase. Currently we use 'Alliedexpress/Startrack/eParcel/Couriersplease for domestic delivery. Within NSW & VIC, customers will receive the goods in 1-3 days. While WA, SA, NT and QLD will take from 3-5 days, Now our global warehouses are ready for online orders for modelers from worldwide. We strongly recommend modelers to place the orders from our global warehouses in order to save the costs. Cost of delivery varies on the size of the order and destination to each country.

§  An itemized Tax Invoice containing the description of products, freight and GST will be attached on the packing box in a sealed bag for Domestic (Australia) order. No GST/Tax for products exported to overseas from our Australia warehouse and global warehouse. Customer is responsible for any applicable taxes, duties or custom fees. Inquiries regarding these fees should be directed to your local relevant authorities. Austars Model is a legitimate company. Please do not request us to falsify product value on the invoices or change tariff codes or product (Country of origin) information. While we ship products to most countries, we cannot ship some products to some countries at this time required by the law (such as LiPo battery by airexpress etc) or credit card security reasons.

§  Please be sure to reconcile the number of boxes shipped with the number of boxes received. On occasion carriers may deliver boxes separately. Please note that ground and air shipments are often assigned to separate trucks and may arrive at different times of the day. Please do not accept boxes with exterior damage. If the box has been delivered without your signature, contact the carrier before opening the package. The carrier will need to inspect the box and verify any damage before refund or replacement can occur.

§  If you receive defective merchandise, please call us for return instructions. In most cases, we will accept returns and make adjustments. Defects found after the product is in use usually fall under manufacturer's warranty. A customer service representative will be happy to help you determine which procedure is appropriate for you.

§  We are not responsible for. If you feel a box has been lost in transit, please call with the order or invoice number and a list of the missing items. A tracer will be initiated at that time. A claim number will be issued if the carrier does not show delivery within 10 days of the scheduled delivery date. Credit will be issued for the missing merchandise when we obtain the claim number from the carrier.

§  Should you receive merchandise that is missing a part, please contact us. We will ensure that you are sent the part from our stock as appropriate.

Product Warranty
We, Austars-Model, guarantee all our products to be free from defect for 30 days after the date of purchase (except LiPo/lifepo4 battery/servos as it is very difficult or impossible to determine it is product quality issue or the operator error). We may be able to accept the defective back for exchange or refund if you find an item you purchased from us is faulty before using it in new condition with original packaging and all accessories included. The sender needs to bear the freight cost. Please do not return the used product without our authorization. For most branded hobby products, please refer to the manufacturer warranty policy (on the manual). If you wish to obtain a longer warranty (out of the factory standard warranty policy) for a product sold by Austars-Model, you may directly contact the manufacturer. Some manufacturers insist on handling defects directly (see your owner's manual).

Product Return Policy:

Austars-Model is a respectable Australian RC hobby company. We hope you will enjoy the products you purchase from us. However we know sometimes this does not happen. If you are not happy with the product you purchased from Austars-Model, we accept merchandise for return that was purchased from Austars-Model within 30 days of receipt. The product must be in new and unused condition and in its original packaging. We are unable to reimburse for return shipping costs. Austars-Model do not accept returns by COD or any other collection method. COD packages will be refused. Packages billing Austars-Model without authorization will result in actual freight charges billed back to sender unless other prior arrangements were agreed and made.  Refunds typically take 3-5 business days from the date of issue, to show up on your account. We will give no credits or refunds for returns that arrive more than (15 days for local Aussie customers purchasing from our Sydney warehouse and 35 days for all customers worldwide purchasing from our global warehouses) from the date of our shipment to you.

 

Austars-Model accepts return of faulty products or damaged products (during the delivery process) with freight free in case replacement with identical new items cannot be processed.  IF THE PRODUCT IS ORDERED AND SHIPPED TO YOU FROM OUR GLOBAL WAREHOUSE, ONLY INTL WARRANTY SERVICE IS AVAILABLE. THAT MEANS YOU NEED TO SEND IT BACK TO OUR GLOBAL WAREHOUSE FOR RETURN/REPAIR ETC. LOCAL PRODUCT WARRANTY CANNOT BE PROVIDED TO AUSTRALIA CUSTOMERS IF THEY PLACE THE ORDER FROM OUR GLOBAL WAREHOUSE. IF YOU ARE AUSSIE MODELLER AND PREFER LOCAL PRODUCT WARRANTY, PLEASE SELECT THE PRODUCTS FROM OUR SYDNEY WAREHOUSE.   HOWEVER, TEAM AUSTARS ALWAYS TRY OUR BEST TO GUARANTEE QC. If a package that has obviously been damaged during shipment is delivered to your door, please refuse the delivery and contact us ASAP, save all packing materials and paper work as well as the damaged product, and request the couriers (delivering company) to make an inspection and sign it. If the damage during shipment was concealed, please contact the courier (delivering company) and us when you discover the damage. YOU MUST KEEP THE DAMAGED carton box until the shipment has been inspected by the carrier. If you attempt to return the merchandise yourself, you will jeopardize our chances of making a claim, and you may not receive credit for the return.  Products must be returned to us for inspection. Should you find a defect or have an item that requires repairs, please address your return to Austars-Model Service at the address below. If you expect the repair costs be covered under warranty, you MUST provide the required invoice or receipt, or a photocopied. In the event that there may be charges not covered by warranty, basic repair service charge $ 45 AUD /hour is payable. Team Austars will find a solution benefiting each party if the shipping cost is very expensive for most large packaging.

For missing parts, we give the customer/buyer 14 days time to report, after this time frame, we will not be responsible for the missing parts. For wrong item or incorrect or incomplete received, please keep all the boxes and contact us within 2 days of receiving the parcel. Photograph the parcel and its contents inside the box and report to us and tell us the order number and problem with the order.
